Right to Manage: Take Control of Your Building

Are you unhappy with how your building is managed?

Right to Manage (RTM) allows a group of leaseholders to collectively gain control of the management of their development. This was granted under the Leasehold and Commonhold Reform Act of 2002.

If you and 50% of your development neighbours are unhappy with the current management, you are in your rights to claim the Right to Manage. This route will allow you to shift management to an RTM designated company, regardless of whether your existing management has acted negligently or not.

However, certain criteria need to be met to qualify for RTM:

  • Each dwelling involved must be an apartment. House are excluded from this legislation.
  • At least 50% of other apartment owners within the development should agree and be willing to support the cause.
  • At least 2/3rd  of the apartment owners should have ‘long leases’
  • At least 75% of the floor area should be used for residential purposes.

RTM route you must follow

If you are eligible for Right to Manage you must follow this specific route, otherwise, your RTM can be unsuccessful. If you follow the timeframes, notice, wording and utilise all the information you are provided, the process should be simple. Route:

  • Contact other leaseholders and gain at least 50% support
  • Issue notices of participation’ to all leaseholder
  • Issue claim notice on the landlord specifying an ‘acquisition date’ to acquire RTM. This must be at least 3 months from the last date the landlord could serve counter-notice)
  • The landlord has 28 days to serve counter-notice if they wish to dispute the claim
  • If a counter-notice is not served then the RTM Co will take over the management on the acquisition date

If necessary, the RTM Co can issue notices to ensure all required management information is provided alongside access to the development

How it works:

  • Meet the criteria: Your building must meet specific conditions, including being primarily residential with mostly long leaseholders.
  • Serve notices: Formal notices are sent to all leaseholders and the landlord.
  • Acquire management: If the landlord doesn’t dispute your claim, you take over management on the specified date.
